The condo corporation, which has only four units in an older detached
house, went to Superior Court to have an Arbitrator's decision
overturned.
The dispute was whether or not the owners had the original board's
permission to make extensive changes to their unit and some common
elements. The Arbitrator dismissed the condominium corporation’s claim,
and he awarded the Paluszkiewiczs $216,643.49 in costs.
The condo corporation's appeal to Superior Court also failed.
The main point here is that Arbitration is not cheap. The $216,643.49
plus the additional Superior Court costs will be split four ways.
