Candidates’ check list

Here is a list of items that a candidate should be aware of during the condominium election process.

Be aware that any complaints about the election process should be brought to the board's and the corporation's lawyer's attention, in writing, before the meeting. Any issues that arise at the meeting must be brought to the chair's attention before the meeting closes.

Complaining about the election process after the meeting is over, may cost you your right to appeal the results to the courts.


Meeting notice
1.
A notice was mailed to all owners giving the date of the AGM and asking all for interested candidates to submit their names and short resumes to be included in the AGM package. A cut-off date for submissions is given.
2.
That candidates that make a request in writing, are given a copy of the owners register. Insure that the owners' names on the proxies you receive match the names shown on the owners' register.

If the candidates are refused a copy of the register, write a letter of protest to the corporation's lawyer and make an objection at the meeting prior to the start of the elections.

If the incumbents or their agents are campaigning for proxies, with copies of the proxy instrument prior to the AGM packages being received by the owners, write a letter of protest to the corporation lawyer.

AGM package
1.
Has the AGM package has been distributed to all the owners a clear 15 days prior to the date of the meeting?
2.
Does the proxy form follows the guidelines shown in the regulations?
3.
Are all the candidates' resumes included in the package?
4.
If the owner-occupied position is up for re-election, this is clearly stated along with the restricted voting rights?
5.
If there are two or more directors to be elected, if one is a director-occupied position, then is it clearly stated there must be two elections?
6.
Are your condo bylaws regarding elections, if any, included in the AGM package?

Your supporters
1.
Are their names shown as the owners on the corporation's register?
2.
Did your supporters fill in their proxy form properly?

Proxies verse ballots
1.
Has the ballot box been inspected prior to the election to insure it is completely empty?
2.
Protest to the chair at the start of the meeting if the proxies and ballots are not properly controlled and accountability maintained during and after registration.
3.
Ask the chair for a ruling on when registration will be closed and when no further proxies will be accepted or ballots handed out.
4.
Protest to the chair if the people at the registration desk are giving ballots to people who have proxies. The proxy form should be the voting instrument.
5.
The chair announces that the quorum has been met and gives the numbers of units represented by proxy and by ballot prior to the start of the meeting. Write those numbers down. The number of proxies and ballots voting should not exceed that number.

If the chair does not state the numbers, ask that he do so.
